Brother Cashback Promotion Terms and Conditions 

1. Defined Terms: 

1.1 In this document: 

Authorised Brother Reseller means a reseller, authorised by Brother to sell Brother products in New Zealand. 

Cashback Amount means the amount identified in the Eligible Cashback Product Matrix.

Cashback Terms means these cashback terms and conditions. 

Claimant means an individual or entity that submits a cashback claim to Brother during a Promotion. 

Brother means Brother International (NZ) Limited. Physical address, 27 Matarawa Place, Tauriko Business Estate, Tauranga 3171. Postal address, PO BOX 248, Seventh Avenue, Tauranga 3140. 

Eligible Product means any machine that is identified in the Eligible Cashback Product Matrix and which has been purchased in New Zealand from an Authorised Brother Reseller during a Promotional Period.

Eligible Cashback Product Matrix means the matrix identifying each Eligible Product, Cashback Amount and relevant Promotional Period, located below.

Promotion means any cashback promotion offered by Brother from time to time. 

Promotional Period means the period identified in the Eligible Cashback Product Matrix.

Valid NZ Bank Account means an active New Zealand bank account in the name of the Claimant.

Working Day means any day other than a Saturday or Sunday or a public holiday observed in Tauranga. 

2. Eligibility 

2.1 To be eligible to make a claim under a Promotion, the Claimant must:
(a) be a New Zealand citizen or resident; 
(b) purchase an Eligible Product from an Authorised Brother Reseller during a Promotional Period; 
(c) purchase an Eligible Product for use in New Zealand, not for commercial resale, rental or lease (i.e. the Claimant must be the end-user of the Eligible Product).
(d) provide Brother with a Valid NZ Bank Account for receiving the Cashback Amount.

2.2 Employees of Brother and any Authorised Brother Reseller are ineligible to make a claim under a Promotion.

3. Brother’s obligation 

3.1 If the Claimant submits a valid claim to Brother in accordance with these Cashback Terms, Brother will process the Cashback Amount for the Claimant. 

4. The claim process 

4.1 Claims are non-transferable and non-assignable. Only the original purchaser and end user of the Eligible Product may submit a claim for the relevant Eligible Product. 

4.2 To make a claim, the Claimant must visit www.brother.co.nz and complete and submit the required information within fourteen (14) days after the end of a Promotional Period. Claims submitted after this period will not be processed.

4.3 To complete the claim, the Claimant must upload a legible copy of the Claimant’s original receipt or tax invoice. 

4.4 The receipt or tax invoice must clearly show:
(a) the Eligible Product(s) purchased; 
(b) the name of the store and/or Authorised Brother Reseller from where or who the purchase was made;
(c) the date of purchase;
(d) the tax invoice number; and
(e) that payment for the Eligible Product(s) has been made in full.

4.5 If the tax invoice or receipt is missing any required information or is deemed illegible or unclear by Brother, the claim will not be accepted. Brother will, however, make reasonable efforts to contact the Claimant to obtain the necessary information.

5. Payment Promise

5.1 Brother will aim to pay the Cashback Amount via EFT to the Claimant’s Valid NZ Bank Account within five (5) Working Days after approving a valid claim (Payment Promise).

5.2 Subject to clause 5.3 below, if Brother does not issue payment in accordance with the Payment Promise, Brother will pay to the Claimant the price the Claimant paid for the Eligible Product(s) less the Cashback Amount.

5.3 It is the responsibility of the Claimant to provide correct details to Brother. Where any delay in payment is caused by the Claimant providing incorrect banking details to Brother, the Payment Promise will not apply. 

6. Claim conditions

6.1 The Claimant may make multiple claims during a Promotion, subject to the following: 
(a) Only one (1) claim can be made per Eligible Product purchased.
(b) No more than three (3) claims may be made for each Eligible Product per Promotion.
(c) Multiple claims that use the same tax invoice or receipt details may be rejected at Brother’s discretion.
(d) If the Claimant returns an Eligible Product for which they have already received a Cashback Amount, they must return the Cashback Amount to Brother. 

7. General Conditions

7.1 Brother may, from time to time and at any time following a claim, take reasonable steps to verify the eligibility of any Claimant or the validity of any claim at any time. Acceptance of a claim or payment of a Cashback Amount does not constitute a waiver of Brother’s right to review, audit or invalidate a claim. If Brother reasonably believes that the Claimant is ineligible or a claim is invalid, Brother may reject the claim and seek repayment of any Cashback Amount already paid. Brother’s decision on eligibility and validity is final.

7.2 Brother reserves the right to amend these Cashback Terms at any time.

7.3 If Brother considers that a Promotion is being misused for fraud, unintended purposes (e.g. profiteering from cashback), or is not being conducted as anticipated, Brother, may, at its sole discretion and to the extent permitted by law:
(a) invalidate any claim;
(b) disqualify the Claimant from participating in any current or future Promotion; or
(c) modify, suspend or cancel the relevant Promotion.

7.4 This Promotion cannot be redeemed in conjunction with any other offer, including any other cashback promotion or rewards program.

7.5 All claim forms and other materials provided by the Claimant to Brother become the property of Brother.

7.6 Payments are not transferable, assignable or exchangeable for other goods or services.

7.7 Brother accepts no responsibility for any tax implications that may arise from a Promotion. Independent financial advice should be sought by the Claimant.

7.8 To the extent permitted by law, Brother excludes all liability for any loss or damage arising from a Promotion, including but not limited to indirect, special or consequential, even if caused by negligence.

7.9 If, for any reason, the limitations and exclusions of liability contained in these Cashback Terms is held to be invalid or unenforceable, the maximum liability of Brother will be limited to $100 New Zealand currency. This limitation of liability will apply regardless of whether the liability arises in contract, tort (including negligence) or any other basis, and in respect of any loss, damage or injury that may result from the Claimant’s participation in a Promotion. 

7.10 Nothing in these Cashback Terms limits, purports to limit or excludes the statutory guarantees under the Consumer Guarantees Act 1993.

7.11 These Cashback Terms are governed by New Zealand law.

8. Privacy

8.1 Brother will collect personal information to conduct a Promotion. Brother will collect, store and use personal information of Claimants in accordance with Brother’s privacy policy at www.brother.co.nz/privacy-policy and the Privacy Act 2020. 

8.2 Unless the Claimant opts out by un-checking the appropriate box on the online claim form, Brother may use the collected personal information for promotional, marketing, and publicity purposes, including sending electronic messages or contacting the Claimant by phone, for an indefinite period unless otherwise notified (Purpose).

8.3 By participating in a Promotion, the Claimant is deemed to have consented to, in accordance with Brother’s privacy policy, the collection, storage and use of the Claimant’s personal information for the Purpose. 

8.4 Each Claimant has the right to request access to, and correction of, any personal information held by Brother. All requests must be made to Brother in writing.
